Regulation (EU) 2023/956 has been amended to simplify and strengthen the Carbon Border Adjustment Mechanism (CBAM), marking the beginning of a new era.
1. INTRODUCTION AND EXECUTIVE SUMMARY
Regulation (EU) 2025/2083, published in the Official Journal on October 17, 2025, has officially entered into force, amending Regulation (EU) 2023/956.
Objective: The revision aims to both simplify and strengthen the implementation of the Carbon Border Adjustment Mechanism (CBAM).
Importer Obligations & Certification: Importer compliance requirements and the certificate system have been restructured.
Administrative Relief: A reduction in administrative burdens is envisaged, particularly for small-scale importers.
Timeline & Technical Details: Technical specifics regarding the implementation timeline and the transitional period have been updated.
2. KEY HIGHLIGHTS
Administrative Simplification: Across CBAM-covered sectors (cement, iron and steel, aluminium, fertilizers, electricity, and hydrogen), the revision seeks to streamline administrative compliance processes.
Registry & Reporting System: The registration and reporting framework for importers has been redefined, with updates specifically targeting the CBAM Transitional Registry module and authorization procedures.
Timeline & Definitive Period: The “transitional period” remains in effect from October 1, 2023, to December 31, 2025, with the definitive regime scheduled to take effect as of January 1, 2026.
Methodologies & Carbon Price Deductions: A critical technical focus of the revision is the clarification of calculation methodologies for embedded greenhouse gas emissions in imported goods. In addition, provisions regarding the deduction of carbon prices paid in third countries and the structuring of the CBAM certificate mechanism have been detailed.
Exemptions for Small Importers: New de minimis / exemption thresholds have been introduced; notably, exemption proposals for importers bringing in less than 50 tonnes of CBAM-covered goods annually have come to the fore.
3. CONCLUSION
This regulatory update marks a critical milestone in the European Union’s commitment to achieving its climate objectives—aiming to ensure a level playing field in imports while mitigating the risk of “carbon leakage.”
While navigating the technical specifics is paramount, the overall framework increases compliance obligations for standard importers while granting administrative relief to smaller market players. For key trade partners with deep EU integration such as Türkiye, early preparation in supply chain visibility and robust emission data management will serve as a significant competitive advantage.
